The American Waterways Operators has filed suit against EPA, seeking to overturn the agency’s section 312(f) certification, an action that took place in the waning hours of the Obama administration. The EPA has a web page with information (including maps) on each No Discharge Zone; enter “EPA” and “No Discharge Zone” into your search engine to locate this information. Each PVA member should take steps to become familiar with the status of the waters on which his or her vessel operates. If the vessel sails on waters not now covered by a NDZ, it is likely only a matter of time before such designa- tion is proposed. Planning ahead for a NDZ can save a lot of agony and expense. Can the vessel be modified so as to eliminate the need for overboard disposal of treated effluent? If so, can such structural changes be done in conjunction with a scheduled visit to a drydock or shipyard? What shoreside or mobile options to receive sewage effluent are available now or can reasonably be installed in the near future? [Note: sometimes, confusion arises as to the Clean Water Act’s requirements for vessel discharge of treated sewage effluent (ncluding No Discharge Zones) and Clean Water Act regulation of other discharges incidental to the operation of a vessel (graywater, ballast water, etc.], controlled by the terms of the EPA Vessel General Permit (VGP). These are separate regulatory requirements.
