MARCH 2019 • FOGHORN 23 T h e F e d e r a l H i g h w a y Administration (FHWA) distrib- utes Ferry Boat Program (FBP) Funds to eligible entities, through State and territorial transportation agencies, for designing and construct- ing ferry boats and for designing, acquiring right-of-way, and construct- ing ferry terminal facilities. The FBP was first created in 2012 in the Moving Ahead for Progress in the 21st Century (MAP-21) Act, and continued in December 2015 in the Fixing America’s Surface Transportation (FAST) Act. FBP Funds are distributed annually according to a formula that is defined in statute. FBP funding distributed during MAP-21 was available for obligation until expended. Many FBP Fund re- cipients planned to accumulate funds over multiple fiscal years, initially delaying the obligation and efficient use of FBP Funding. The FAST Act modified the distribution formula and added a subsection requiring redistri- bution of FBP funding that was not obligated within a specific time frame. Under this provision, FBP funds that are not obligated within three years after the fiscal year for which amounts were first distributed are required to be redistributed to re- cipients that did not have funding withdrawn. This applies to FBP funds distributed for FY 2013 and beyond. Distribution memos are located on the FBP website address found later in this article. FBP Funds initially distributed in Fiscal Years (FY) 2013, 2014, 2015, and 2016 must be obligated by the end of FY 2019 (that is, by September 30 of this year). Any unobligated funds remaining on September 30 will be withdrawn and redistributed in FY 2020.
